Terms & Conditions for Website Development


Definitions

The following Terms and Conditions document is a legal agreement between Web India Solutions, hereafter “the WIS”, and “the Client” for the purposes of website design or development and other services provide by the WIS. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.

The WIS is an Internet web design provider offering the Client graphical design, HTML, CSS, Javascript, PHP, and other related computer programming languages. WIS also provides Print designs, Corporate Branding and Identity, Social Media Promotions and Mobile App development.

Permission and Copyright

Copyright of the completed designs, images, pages, code and source files created by the WIS for the project shall be with the Client upon final payment only by prior written agreement. Without agreement, ownership of designs and all code is with the WIS.

These terms of use grant a non-exclusive limited license so that the Client can use the design on one website on one domain name only. The Client is not permitted to use a design for more than one website without prior written agreement between the Client and the WIS.

The Client agrees that resale or distribution of the completed files is not allowed unless prior written agreement is made between the Client and the WIS.

The Client hereby agrees that all media and content made available to the WIS for use in the project are either owned by the Client or used with full permission of the original authors. The Client agrees to hold harmless, protect and defend the WIS from any claim or suit that may arise as a result of using the supplied media and content.

The Client agrees that the WIS may include development credits and links within any code the WIS designs, builds or amends. If the WIS designs a website for a Client, then the Client agrees that the WIS may include a development credit and link displayed on the Client’s website.

The Client agrees that the WIS reserves the right to include any work done for the Client in a portfolio of work.

The Client agrees to abide by the terms of any third party software or media included within any work done for the Client. Examples of this include, but are not limited to, Googlemaps, Media under the Creative Commons license, RSS feeds, Open Source GPL Software etc.

Initial work

After the purchase is made from the website, a confirmation email will be send to the Client. WIS team will analyze the order and then contact the Client if any clarifications are required regarding the website requirements. The website is then made live within the stipulated period of time.

Though we expect to deliver the website within 24 hours, the time required to complete the project varies according to the requirement of the client. The Client needs to give a definite idea of the design/theme/ color and all aspects, if any, before commencing the project.

Alteration work

In case of any alterations, the changes should be informed within the first three days after the website has been made live. We will not undertake any further works unless confirmed and your payments will not be refunded back.

Redesign Clauses

If changes are suggested after the completion and approval of the entire website, it will be considered as redesign and will be chargeable. Detection of errors in contents or designs by the customer, if any, will be rectified immediately. After completion of the project, we will upload the whole works in our server and we will send you a link for website testing. The whole work will be uploaded in your server after the final approval of the project and the settlement of balance amount.

Free Maintenance

One year free maintenance towards all kinds of errors occurred in run time. Free maintenance does not include content updation.

Refund and cancellation

Once the project is cancelled, the payment is not refundable.


Material rights

The WIS reserves the right to refuse to handle:
Any media that is unlawful or inappropriate.
Any media that contains a virus or hostile program.
Any media that constitutes harassment, racism, violence, obscenity, harmful intent or spamming.
Any media that constitutes a criminal offence, or infringes privacy or copyright.
